MEMBERS of West Devon Borough Council have voted unanimously to defend the claim for a judicial review of the council's decision to grant planning permission for a supermarket on the former Focus Do It All site in Plymouth Road, Tavistock. Cllr Robert Oxborough, chairman of the council's communities services committee, in collaboration with Morrisons, is seeking a judicial review of the planning consent given in January this year for change of use of the building, because he believes the planning decision was unlawful. But there is concern that the legal action could cost the council a large amount of money. Last year the authority spent £50,000 on a court action, which it lost, against its own planning decision, relating to the same site, which failed to impose a restriction on it as a non-food outlet. Following a special meeting of the borough council last Thursday, a spokesperson for the authority said: 'Councillors carefully considered the issues and decided it was in the public interest to fully and robustly defend the claim for a judicial review. 'The 23 councillors who attended the special meeting voted unanimously to defend the council's position. 'The High Court will now consider the arguments over the next few weeks.'
