MANY readers will be familiar with the local amenity known as West Down, an area of land immediately north east of Doublewaters, where the Tavy and Walkham meet. Readers will also know, by reference to OS map 1:50,000 and 1:25,000 of the relevant area that a public/pedestrian right of way, enshrined in law, exists both from West Down (east) gate and West Down (west) gate to the common and beyond. West Down is an area much loved by pedestrians, dog walkers, horse riders, family groups and drivers who park up to enjoy the view and take in the afternoon sun. These rights have been exercised and enjoyed for over 100 years. These rights are coming under direct threat, starting on July 7 when both gates were chained, padlocked and access denied to all. Given the public rights of way, this was clearly an illegal course of action and in direct contravention of the laws of the land. On July 8, I watched as an elderly lady attempted to climb over West Down (east) gate, lost her balance and fell heavily, suffering pain and distress. Thus the closure of the gates, and consequent denial of access, was not only illegal but also an act unlikely to find favour with the general public. These closures were initiated, I understand, through fears that some itinerant travellers might just decide to park on West Down. Yes, West Down does have the occasional rogue driver and the very occasional camper, but nothing to justify the draconian actions taken throughout the past week. Occasional infringements are just part and parcel of land custodianship. I further understand that new gates are to be fitted, allowing access to pedestrians and horse riders, but denying access to all drivers beyond the gates. This might, I suppose, be within the law for the land owner to initiate. But, how unnecessary and what an amenity loss for local people. In conclusion, if you enjoy driving through West Down gate (west), parking up, sitting in the sun and eating your jam sandwich, then it may well be time to speak up.
