TWO directors of a property company face a possible prison sentence if they fail to complete works to a Gunnislake housing estate that have remained unfinished for almost three years. Plymouth County Court has granted an injunction against Roussillon Properties Ltd directors Chris Andrew Speed, of Hatt and Graham Eric Wood, of Saltash, potentially making them personally liable to carry out the works to the Sandhill Park estate in Gunnislake by 4pm on November 23. If they fail to do so, they could be imprisoned, fined or have their assets sequestrated. Caradon District Council says that although the final dwelling at Sandhill Park was occupied in December 2004, Roussillon Properties have not completed the roadways and pavements for the estate, installed street lighting or carried out its obligation to flush out the highway drains annually. In March 2006, the council took the matter to Bodmin Magistrates? Court where Roussillon was fined £750 plus costs of £2,400 for failing to comply with an enforcement notice requiring it to complete the highway works at Sandhill Park. With the works still incomplete more than a year later, Caradon in May this year took the case before Exeter County Court which granted an injunction requiring Roussillon to finish the work by June 1. During that hearing, the judge indicated that it was evident the council had done everything it could to ensure the developer carried out the work. By September 28, the works remained incomplete and Caradon put the matter before Plymouth County Court, which granted the injunction, potentially making Mr Speed and Mr Wood personally liable for the works. Roussillon Properties Ltd has also allegedly failed to carry out landscaping works to the site and has failed to construct a Cornish hedge, both of which were required as part of the original planning consent for the site granted in 2003. These matters are subject to separate enforcement action.
