AN INJUNCTION has been granted against a housing developer requiring it to complete works to a housing estate in Gunnislake that have remained unfinished for more than two years. Exeter Crown County Court granted an injunction against housing developer Roussillon Properties Ltd requiring it to complete the work by June 1 this year. Although the final dwelling at Sandhill Park, Gunnislake, was occupied in December 2004, the court heard that Roussillon Properties had still not completed the roadways and pavements for the estate, installed street lighting or carried out its obligation to flush out the highway drains annually. In March 2006 Caradon District Council took the matter to Bodmin Magistrates Court, where Roussillon was fined £750 plus costs of £2,400 to comply with an enforcement notice requiring it to complete the works at Sandhill Park. With the works still incomplete more than a year later, Caradon took the case before Exeter Crown County Court. During the county court hearing, the judge indicated that it was evident that the council had done everything it could to ensure the developer carried out the work and that it was plain that the defendant was wilfully seeking to avoid their obligations under the terms of the consent. Mark Andrews, Caradon's assistant head of development control, said: 'This has been a most unsatisfactory situation that has given rise to real hardship and loss of amenity to the residents, who have been living on the estate for several years. 'Caradon is determined to ensure that the developer does not avoid his responsibilities, and this ruling lays down a marker for any other developers that think they can shirk their obligations to residents.' Mr Andrews said if the company did not carry out this work it would be in contempt of court, which was a very serious matter. Resident of Sandhill Park Leonard Newland said he had lived on the estate for three and a half years and during that time nothing had happened regarding completing the work, 'Everyone living here is totally fed up with it,' he said. 'I just hope now that the work will get done.' Roussillon Properties were unavailable for comment as the Times went to press.
